Mark Rasch notes in his SecurityFocus Column that a court in New Hampshire has ruled that the recording of chat logs in New Hampshire requires the consent of all chat participants. That’s because New Hampshire is a “two-party consent state.”
Of course, this doesn’t apply to conversations crossing state lines. It also doesn’t apply to service providers, since the Electronic Communications Privacy Act provides the right to record basically anything they want.
